These Terms and Conditions of Use supplement the Terms and Conditions of Sale and the Privacy Policy.
1. PURPOSE
The purpose of these General Terms of Use (hereinafter referred to as "the GTU") is to define and govern the terms of use of the website www.limky.fr (hereinafter referred to as "the Site") by users (hereinafter referred to as "the Users").
In order to access the Site, as well as all its services, you must unreservedly accept and comply with the latest version of these General Terms of Use.

3. SERVICES OFFERED BY THE SITE
The purpose of the Site is the presentation, sale and promotion of the Publisher's products (hereinafter referred to as "the Services"). These Services include :
- The possibility for the User to buy one or more products marketed by the Publisher. To do so, the User must refer to the General Terms of Sale made available to him.
- The possibility for the User to subscribe to a newsletter service, allowing him to be regularly informed of the last news and information relating to the Editor and its products. To do this, the User must, on the Site, in the Newsletter section, fill in his email address, to which the newsletter will be sent.

For any question, complaint or request for information concerning the Site, or any report of contents or illicit activities, the User can contact the Editor at the email address hello@limky.fr
5. ACCEPTANCE OF THE CGU
Access to and use of the Site are subject to acceptance and compliance with the GCU. This acceptance and this respect are considered to be given by the User at the opening of the Site.
The TOS apply, as necessary, to any variation or extension of the Site on existing or future social networks and/or communities.
The Editor reserves the right to modify, at any time and without notice, the Site, the Services as well as the TOS, in particular to adapt to the evolutions of the Site by the provision of new functionalities or the suppression or the modification of existing functionality.
The User is therefore advised to refer to the latest version of the TOS before any browsing, which is accessible at any time on the Site. In case of disagreement with the GTU, no use of the site can be made by the User.
6. ACCESS AND NAVIGATION
The access and the navigation on the Site, allowing to benefit from the Services, is done by the means of an Internet connection.
The Publisher implements the technical solutions at its disposal to allow access to the Site 24 hours a day, 7 days a week.
The Editor is subject to an obligation of means as to access and navigation on the Site and makes its best efforts to ensure such access and navigation. Nevertheless, the Publisher shall not be held responsible for any malfunctioning of the Site or unavailability of the Services and shall not pay any compensation to the User.
The Publisher may at any time suspend, limit or interrupt access to the Site or to certain pages of the Site in order to make updates, changes to its content or any other action deemed necessary for its proper functioning.
7. RESPONSIBILITIES
The Publisher is only responsible for the content that it has published itself.
However, it cannot guarantee the accuracy, the completeness, and the topicality of the information which is diffused on the Site.
The Editor is not responsible :
- technical problems or failures, computer or compatibility of the Site with any hardware or software;
- direct or indirect, material or immaterial, foreseeable or unforeseeable damage resulting from the use or the difficulties of use of the Site or the Services;
- the intrinsic characteristics of the Internet, in particular those relating to the lack of reliability and the lack of security of the information circulating on it.
The User is responsible for the use and protection of the equipment he/she uses to browse the Site, for the use he/she makes of the Site and the Services, and for any violation of the TOU.
The following are strictly prohibited: (i) any behavior likely to interrupt, suspend, slow down or prevent the proper functioning of the Site, (ii) any intrusions or attempted intrusions into the Publisher's systems, (iii) any misappropriation of the Site's system resources, (iv) any actions likely to impose a disproportionate burden on the latter's infrastructure, (v) any infringement of security and authentication measures, (vi) any acts that may infringe the rights and financial, commercial or moral interests of the Editor or users of its Site, (vii) any practice diverting the Site for purposes other than those for which it was designed and finally more generally (viii) any breach of the TOS or the laws and regulations in force.
It is also strictly forbidden to monetize, sell or grant all or part of the access to the Site, as well as the information it contains.
In case of breach of any of the provisions of this section or more generally, of any violation of laws and regulations, the Editor reserves the right to take all appropriate measures, to seek damages and to take any legal action.
8. HYPERTEXT LINKS
The Site may contain hypertext links to other websites over which the Editor has no control. In spite of the preliminary and regular checks carried out by the Editor, the latter declines any responsibility as for the contents which it is possible to find on these sites.
In addition, the prior information of the Website Editor is necessary before any hypertext links are set up.
Are excluded from this authorization the sites diffusing information with illicit, violent, polemic, pornographic, xenophobe character or being able to attack the sensitivity of the greatest number.
Finally, the Editor reserves the right to remove at any time a hypertext link pointing to his Site, if he considers it not in conformity with his editorial policy.
The Editor is not responsible for transactions between the User and any advertiser to which the User would be directed through the Site and will not be party to any dispute in this regard.

The Publisher has a Privacy Policy which the User is expressly invited to read in the privacy policy section.
10. INTELLECTUAL PROPERTY
The structure of the Site but also the texts, graphics, images, photographs, sounds, videos, computer applications and databases, which compose it, as well as the trademarks and other intellectual property rights relating to the products of the Editor presented, sold and promoted on the Site (hereinafter referred to as "the protected Elements"), are the property of the Editor and are protected as such by the laws in force under the title of intellectual property.
Any representation, reproduction, adaptation or exploitation, partial or total, of the Protected Elements, by any process whatsoever, without the prior, express and written authorization of the Publisher, is strictly forbidden and would be likely to constitute an infringement within the meaning of the provisions of the Intellectual Property Code.
Any practice known as "webcrowling" is also prohibited
Access to the Site and its use do not constitute recognition of a right and, in general, do not confer any intellectual property right relating to the protected Elements, which remain the exclusive property of the Publisher.
It is forbidden to the User to introduce data on the Site which would modify or which would be likely to modify the contents or the appearance.
11. APPLICABLE LAW AND JURISDICTION
The TOS are governed by French law.
In the event of a dispute and in the absence of an amicable agreement within one (1) month of the dispute arising, the dispute will be brought before the competent courts of Paris.
